Abstract

This study aims to identify the nature of international sports arbitration, the Sports Court in Iraq, and how to arbitrate sports disputes in Iraq. It also explores the Sports Settlement and Arbitration Center in Iraq and the legal and regulatory challenges it faces. The research problem lies in the existence of obstacles that hinder the resolution of sports disputes through arbitration by institutions specialized in sports law, coupled with the absence of a unified sports law governing Iraqi sports. The significance of the study stems from delving into a sensitive and vital issue for athletes and sports organizations in Iraq and highlighting the shortcomings that hinder the proper functioning of sports activities in a manner that aligns with international legal sports standards.

The researcher uses a descriptive-analytical approach, relying on the inductive method to collect, analyze, and interpret information to extract results.

The study concludes that there is a lack of knowledge among sports sector employees regarding laws and regulations that govern the sector in accordance with international standards. The researcher recommends establishing academic institutions that suit the current work environment, operating in a theoretical and  practical manner, and specializing solely in sports law to prepare generations of sports legal professionals who contribute to organizing and managing the sports sector effectively.
